I. Purpose and Scope

Recognizing that providing a safe learning environment to students, faculty, college employees, campus visitors, and the surrounding neighborhood is one of the most vital ingredients in providing a quality educational experience. The NH Community Technical College-Berlin hereby adopts the following Comprehensive Campus security policy, the provisions of which are made applicable to students, faculty, employees and others who utilize the facilities of our college.

It is the intention of the college that this policy shall comply with the provisions of the federal Student Right-to-Know and Campus Security Act, and the rules of the US Department of Education adopted to implement this Act. It is also the intention of the college administration to take appropriate disciplinary action against persons who commit prohibited acts or fail to perform required acts under this policy.

II. Definitions

The following words and phrases shall have the meanings ascribed to them in this section wherever they appear in the following policy, unless the context shall indicate otherwise:

A. Campus

Any building owned or controlled by the college within the same reasonably contiguous geographical area and used by the college in direct support of, or related to, its educational purposes, and any building or property owned or controlled by a student organization recognized by this institution. The campus does not include any publicly-owned streets.

B. Arson

To unlawfully and intentionally damage, or attempt to damage, any real or personal property by fire or incendiary device.

C. Aggravated Assault (1st- and 2nd-Degree Assault)

The unlawful physical attack by one person upon another wherein the offender uses a weapon or displays it in a threatening manner, or the victim suffers obvious severe or aggravated bodily injury involving apparent broken bones, loss of teeth, possible internal injury, severe laceration, or loss of consciousness.

D. Simple Assault

An unlawful physical attack by one person upon another where neither the offender displays a weapon, nor the victim suffers obvious severe or aggravated bodily injury.

E. Burglary

The unlawful entry into a building or other structure with the intent to commit a theft or another crime.

F. Criminal Mischief with the Intent to Commit Any Crime

To willfully or maliciously destroy, damage, deface, vandalize, or otherwise injure, real or personal property without the consent of the owner or the person having custody or control over it.

G. Sexual Assault

Any sexual act directed against another person, forcible and/or against that person's will; or where the victim is incapable of giving consent.

H. Murder and Non-Negligent Manslaughter

The willful non-negligent killing of one human being by another.

I. Robbery

The taking, or attempting to take, anything of value under confrontational circumstances from the control, custody, or care of another person by force or threat of force or violence and/or by putting the victim in fear of immediate harm.

J. Weapon Law Violations

The violation of laws or ordinances prohibiting the manufacture, sale, purchase, transportation, possession, concealment, or use of firearms, cutting instruments, explosives, incendiary devices, or other deadly weapons.

K. Disorderly Conduct

Any behavior which tends to disturb the public peace or decorum, scandalize the community, or shock the public's sense of morality, including fighting in public and making loud and unreasonable noises to the disturbance of others.

L. Liquor Law Violations

The violation of laws or ordinances prohibiting the manufacture, sale, purchase, transportation, possession or use of alcoholic beverages.

M. Trespass

To unlawfully enter land, a dwelling, or other real property, or remain thereon after being requested to leave by the owner or lawful occupant.

N. Drugs/Narcotics Violations

The unlawful cultivation, manufacture, distribution, sale, purchase, use, possession, transportation, or importation of any controlled drug or narcotic substance.

O. Larceny/Theft Offenses

The unlawful taking, carrying, leading, or riding away of anything of value from the possession of, or the constructive possession of another person.

P. Motor Vehicle Theft

The theft of a motor vehicle.

III. Reporting of Crimes

A. It is the responsibility of any student, teacher, administrator or employee of the college who becomes aware of any of the above crimes committed on campus to immediately report such crime both to the local police department and to the Dean of Student Affairs.

B. It shall be the responsibility of the Dean of Student Affairs to compile statistics on each reported crime and provide them annually for distribution through appropriate publications and mailings. The report shall be published by September 1 of each year and shall provide campus crime statistics for the prior three calendar years.

C. It shall also be the responsibility of the Dean of Student Affairs to provide periodic, timely reporting to the campus community of crimes that are considered by the institution to represent a threat to students and employees, including murder, rape, aggravated assault, sex offenses, robbery, burglary, arson and motor vehicle theft.

D. It shall also be the responsibility of the Dean of Student Affairs to make a formal record of all arrests known to them occurring on campus for liquor law violations, drug abuse, violations, vandalism, and weapons possession, and to make these statistics available by September 1 of each year for publication and distribution through appropriate campus publications. These arrest statistics shall cover the most recent calendar year.

E. It is the policy of the college that information about campus crimes not be withheld from the Dean of Students or Campus Security Department, nor from any law enforcement unit by college students, employees, or residence officers.

F. In reporting campus crimes, the Dean of Student Affairs shall be certain to note in a separate portion of the annual report, any hate-motivated crimes which appear to have been motivated because of the victim's race, nationality, creed, sexual orientation, or religion.

IV. Crime Prevention and Mitigation

A. It shall be the responsibility of the Dean of Student Affairs in cooperation with the residence halls or other appropriate delivery system to sponsor at least one campus assault program aimed at the prevention of sex offenses including information about rape awareness, acquaintance rape, and other forcible and non-forcible sex offenses, during each academic year.

B. It shall also be the responsibility of the Dean of Students in cooperation with the residence halls or other appropriate delivery system to provide at least one annual drug- and alcohol-abuse forum on campus during each academic year.

C. The Dean of Student Affairs shall distribute each academic year a Student Handbook to each student at the college which shall contain crime prevention tips and information regarding existing counseling, mental health or student services available on campus and within the local community.

V. Security and Access

A. It shall be the responsibility of the Maintenance Department to provide reasonable lighting of parking lots and outdoor areas frequented by students, and to provide appropriate key control and security to campus facilities.

B. It shall be the responsibility of the Dormitory Supervisor to provide security and access control to all campus residences, through the issuance of keys, key cards, or other means to allow access to the dormitory areas only by authorized persons, and to keep dormitory exterior doors locked at all times.

VI. Campus Police

A. It shall be the responsibility of the Dean of Student Affairs to meet periodically with the local police department to establish a working relationship and encourage accurate and prompt reporting to the college of crimes involving students or occurring on the campus handled by local police, and to enhance the awareness of college authorities of the extent of the campus crime problem.

C. Due to the relatively small amount of disturbances on campus, it has not been found necessary to employ any college security officers. Local police respond quickly when called to handle crime problems on the campus, and any student having a problem should contact the local police and the main college office. Police may be reached 24 hours a day at 752-3131.

VII. Alcohol and Drugs

The NH Community Technical College at Berlin is a chemical-free campus. The possession, use, and sale of alcohol or illegal drugs on campus is strictly prohibited, as is the furnishing to or use of alcoholic beverages by minors.

VIII. Weapons

It is the policy of the NH Community Technical College at Berlin not to allow any firearms, knives, martial-arts weapons, or any other type of deadly weapon on the campus at any time, except with permission of the President as part of a course of instruction. Any student bringing a weapon on campus should bring it immediately to the President's Office (or other designated location) and it will be placed under lock and key.

IX. Disciplinary Action

Students or employees who are victims of criminal acts by a student on campus are entitled to request from the Dean of Student Affairs a disclosure of what disciplinary action was taken by the college as a result of their complaint. It will be within the discretion of the Dean of Student Affairs whether to make this information available, but it is the policy of the college to comply with such requests whenever it is appropriate to do so, taking into consideration an appropriate balancing of the rights of the victim, the due process rights of the accused, and the best interests of the college community.

X. Off-Campus Activities

Any students residing at recognized off-campus organizations are encouraged to report crimes to the college authorities as well as to the local police department.

XI. Disclosures by Admissions Office

The Admissions Office shall disclose campus crime and arrest statistics to applicants for enrollment at the college upon request.

XII. Student Services Office

The Student Services Office shall disclose campus crime and arrest statistics to applicants for employment at the college upon request.

XIII. Residence Life

The Dean of Student Affairs, in cooperation with the residence authorities shall develop and maintain annual programs for crime prevention, rape prevention, and alcohol and drug abuse prevention counseling and make them available to students, as well as maintaining a list of community agencies providing similar programs.

XIV. Public Information

A. The Dean of Student Affairs shall publish and distribute an annual security report to all students and employees and make it available to the Financial Aid Office in order that that office may make the annual certification of compliance with the Student Right-to-Know Act to the US Department of Education.

B. The Dean of Student Affairs shall also, as necessary, disseminate to the campus community timely reports of crimes considered to be a threat to students, in a manner that will aid in the prevention of similar occurrences.

XV. Security Office

A. The Dean of Student Affairs shall negotiate with the local policy department to obtain information with regard to crimes reported off-campus that may pose a threat to students and employees and be subject to timely notice requirements of the Student Right-to-Know law.

B. The Dean of Student Affairs shall also assist in compiling crime and arrest statistics and timely reports of crimes for public information and shall provide technical advice to all other affected units and administrators with regard to security matters.
